Terms of Service — Stonks Interactive

1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("you" or "User") and Stonks Interactive ("we," "us," or "our"). These Terms govern your access to and use of our applications, games (including but not limited to The Descender and House Edge), our website at stonksinteractive.com, and any related services (collectively, "Services").

By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use our Services.

2. Eligibility

You must be at least 13 years of age to use our Services. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf. We do not knowingly allow individuals under 13 to use our Services.

3. License Grant

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to:

Access and use our website for personal, non-commercial purposes.
Download, install, and use our games and applications on devices you own or control, for personal, non-commercial entertainment purposes.

This license does not include the right to:

Modify, decompile, reverse engineer, or disassemble our games or applications, except to the extent permitted by applicable law.
Copy, distribute, sell, lease, sublicense, or otherwise transfer our games or applications to any third party.
Use our Services for any commercial purpose without our prior written consent.
Remove, alter, or obscure any copyright, trademark, or other proprietary notices in our Services.

4. Intellectual Property

All content, features, and functionality of our Services — including but not limited to game code, artwork, audio, text, graphics, logos, trademarks, and trade dress — are owned by Stonks Interactive and are protected by copyright, trademark, and other intellectual property laws.

The Stonks Interactive name, logo, "The Descender," "House Edge," and all related names, logos, product and service names, designs, and slogans are trademarks of Stonks Interactive. You may not use these marks without our prior written permission.

5. Free Assets & Community Resources

We may make certain assets (3D models, textures, templates, tutorials, etc.) available for free download through our website. Unless otherwise stated on the specific asset page, free assets are provided under the following terms:

You may use free assets in personal and commercial projects.
You may not resell, redistribute, or sublicense the raw assets themselves (i.e., you cannot repackage and sell our assets as an asset pack).
Credit to Stonks Interactive is appreciated but not required unless otherwise stated.

We reserve the right to change the license terms for future asset releases at any time.

6. User Conduct

When using our Services, you agree not to:

Violate any applicable law, regulation, or third-party rights.
Use our Services to transmit harmful, offensive, threatening, abusive, or otherwise objectionable content.
Attempt to gain unauthorized access to our Services, servers, or systems.
Use cheats, exploits, automation software, bots, hacks, mods, or any unauthorized third-party software designed to interfere with our Services.
Interfere with or disrupt the integrity or performance of our Services.
Impersonate any person or entity, or falsely state or misrepresent your affiliation with any person or entity.

7. Third-Party Platforms

Our games may be distributed through third-party platforms including but not limited to the Meta Horizon Store and Steam. Your use of those platforms is subject to their respective terms of service and policies, in addition to these Terms.

We are not responsible for the practices, policies, or content of third-party platforms. Any purchases made through third-party platforms are subject to the refund and payment policies of those platforms.

In the event of a conflict between these Terms and a third-party platform's terms, these Terms govern your relationship with Stonks Interactive, while the platform's terms govern your relationship with that platform.

8. Disclaimers

Our Services are provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that our Services will be uninterrupted, error-free, secure, or free of viruses or other harmful components. You use our Services at your own risk.

Health & Safety

Some of our games are designed for virtual reality (VR) platforms. VR experiences may cause motion sickness, disorientation, eye strain, or other discomfort in some users. Please follow the health and safety guidelines provided by your VR headset manufacturer. Discontinue use immediately if you experience discomfort.

Our games contain horror content including but not limited to jump scares, dark environments, disturbing imagery, and intense audio. This content is intended for mature audiences. Use discretion and be aware of your comfort level.

9. Limitation of Liability

To the fullest extent permitted by applicable law, Stonks Interactive, its owners, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, resulting from:

Your access to or use of (or inability to access or use) our Services.
Any conduct or content of any third party on or related to our Services.
Any content obtained from our Services.
Unauthorized access, use, or alteration of your transmissions or content.

In no event shall our total aggregate liability exceed the amount you paid to us, if any, in the twelve (12) months preceding the claim.

10. Indemnification

You agree to defend, indemnify, and hold harmless Stonks Interactive, its owners, employees, and affiliates from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of our Services.

11. Termination

We reserve the right to suspend or terminate your access to our Services at any time, with or without cause and with or without notice. Upon termination, your license to use our Services is immediately revoked.

All provisions of these Terms that by their nature should survive termination shall survive, including but not limited to ownership provisions, warranty disclaimers, indemnification, and limitations of liability.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law provisions. Any disputes arising from these Terms or our Services shall be resolved in the courts of competent jurisdiction.

13. Changes to These Terms

We may update these Terms from time to time. When we make changes, we will update the "Last updated" date at the top of this page. Your continued use of our Services after any changes constitutes your acceptance of the updated Terms. We encourage you to review this page periodically.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Stonks Interactive regarding the use of our Services and supersede all prior agreements, representations, and understandings.
